Topic: Who is liable? The legal situation in the event of incorrect translations. Standard-compliant solutions.

Incorrectly translated documents can not only cause economic damage but can also damage a company’s image or cause personal injury. Not only the gravity of an error, but also its predictability and the corresponding prevention possibilities form the basis on which the degree of liability and legal responsibility are measured. The financial consequences or even consequences under criminal law can be considerable.

To avoid legal consequences, reliable instruments are required, which can make the errors and their causes visible, but which can also be utilized for the standard-compliant documentation of the current quality assurance activities.

Under the Motto “Who is liable? The legal situation in the event of incorrect translations. Standard-compliant solutions”, the connections between legal requirements and prevention measures to avoid liability cases with damage claims will be looked into and discussed.

As a competent legal expert, we shall be welcoming Mr Mario Prudentino, attorney and partner at Passarge, Prudentino & Rhein, who, focusing on international product and manufacturers’ liability, will give an elaborate introduction into the topic area of compliance in the translation sector.

  • Registration and greeting

1.30 pm – 2 pm: Introduction into the topic “Translation risk management”

  • Current guidelines and standards define the demand placed on translations primarily by stipulating translation processes and quality assurance instruments, such as revision and error categories. However, the high degree of abstraction of the standards often leads to a lack of clarity during their implementation. The actually existing quality requirement can be determined more closely on the basis of practical examples of incorrect translations.

2 pm – 2.30 pm: The legal situation in the event of incorrect translations & compliance

  • Attorney Mario Prudentino enables an insight into the current legal situation. Based on the differentiation between product liability and manufacturers’ liability and on the basis of incorrect translations, he will give an introduction into the topic area of compliance in the translation sector. He will also deal with the question of how the risks of incorrect translations and the legal claims are to be evaluated and which minimal requirements have to be observed.

2.30 pm – 3.15 pm: Podium discussion with attorney Mario Prudentino and round table discussion

  • General and specific questions concerning the liability issue will be presented in the round table discussion, which will also deal with who in the process chain is liable for errors and the resulting consequences: the individual translator, the translation service provider, the manufacturer’s department manager or all parties that are involved.

3.15 pm – 3.45 pm: Coffee break

  • Break with coffee and snacks in the foyer

3.45 pm – 4.15 pm: Case examples

  • Selected case examples of incorrect translations will be used to explain the degree of liability and legal responsibility.

4.15 pm – 5 pm: myproof® as a process routine
